Acceptance of Terms
By accessing the website at werunwp.com or engaging We Run WP for any service, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with and be bound by these Terms of Service.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
Services Description
We Run WP provides WordPress-related professional services, including but not limited to:
- WordPress web design and development
- Website migration and hosting setup
- WordPress maintenance (updates, backups, security monitoring)
- SEO optimization and performance enhancement
- Google Ads conversion tracking setup (GTM, GA4)
- Web analytics and automation setup
- On-demand developer support
The specific scope of services for each engagement is outlined in the corresponding quote, proposal, or service agreement provided to the client.
Client Responsibilities
To enable We Run WP to deliver services effectively, you agree to:
- Provide accurate, current, and complete information necessary for service delivery
- Grant necessary access to your WordPress admin, hosting account, or third-party tools as required
- Maintain a backup of your website before we begin any major work (we will also create backups where applicable)
- Review and approve deliverables in a timely manner
- Respond to our communications within a reasonable timeframe (typically 3 business days)
- Ensure you have legal ownership or rights to all content, images, and assets provided to us
Delays caused by lack of client response, missing access credentials, or incomplete information may affect project timelines and are not the responsibility of We Run WP.
Payment Terms
Subscription Services
Our monthly maintenance plans are billed in advance on a recurring monthly basis. Subscription fees are non-refundable once the billing cycle has begun and services have commenced.
Project-Based Services
For one-time projects (web design, migration, tracking setup), a deposit of 50% is required before work begins. The remaining balance is due upon project completion and prior to delivery of final files or credentials.
On-Demand Support
Hourly on-demand support is billed at $99/hour. You will always be notified of the estimated hours before work begins, and no charges will be made without your prior approval.
Late Payments
Invoices unpaid after 14 days may result in suspension of services. We reserve the right to charge a late fee of 1.5% per month on overdue balances.
Cancellation & Refunds
You may cancel your monthly subscription at any time. Cancellation will take effect at the end of the current billing period. No partial refunds are issued for unused portions of a subscription month.
For project-based work, the initial deposit is non-refundable if work has commenced. If We Run WP fails to deliver the agreed service within the agreed timeframe without cause, a proportional refund may be issued at our discretion.
Chargebacks or payment disputes initiated without first contacting us at [email protected] may result in immediate termination of all services and may be pursued legally.
Intellectual Property
Upon receipt of full payment, all custom design and development work created specifically for your project becomes your property. We retain the right to showcase completed work in our portfolio unless you request otherwise in writing.
Third-party themes, plugins, stock images, or licensed assets used in your project remain subject to their respective licenses. We Run WP does not transfer ownership of third-party licenses.
The We Run WP name, logo, website content, and proprietary tools remain the exclusive intellectual property of We Run WP and may not be reproduced without written consent.
Confidentiality
We Run WP agrees to keep all client information, login credentials, business data, and project details strictly confidential. We will not disclose your information to third parties except as required to deliver the agreed services or as required by law.
Clients agree not to share or distribute any proprietary processes, tools, or methodologies disclosed by We Run WP during the course of engagement.
Limitation of Liability
We Run WP provides services on an "as is" and "as available" basis. While we take every precaution to ensure quality outcomes, we do not guarantee specific results such as search engine rankings, ad conversion rates, or business revenue growth.
To the maximum extent permitted by applicable law, We Run WP shall not be liable for:
- Loss of data, revenue, or profits resulting from website downtime or migration errors
- Damage caused by third-party plugins, themes, or hosting providers
- Any indirect, incidental, or consequential damages arising from use of our services
Our maximum liability for any claim shall not exceed the total amount paid by you for the specific service in the 30 days preceding the claim.
Termination
Either party may terminate a service agreement with written notice (email is acceptable). We reserve the right to immediately terminate services without refund in cases of:
- Abusive, threatening, or harassing behavior toward our team
- Non-payment after reasonable notice
- Violation of these Terms of Service
- Requests to perform illegal or unethical activities
Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising under these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration.
